Terms of Business
Please note, that by sending an online order you fully accept these terms and
shipping conditions of Honig´s Europe.
1. General
All offers, orders and deliveries fully subject to these terms. All other agreements
and changes have to be confirmed by Honig´s Europe in written.
Honig´s Europe does not take any responsibility for differences between
pictures or drawings and the original (i.e. colour, size) as well as misprints.
Honig´s Europe is under no circumstances responsible for injuries or
other damages of any kind, which result from an improper using of equipment,
as well as using damaged equipment.
2. Orders and Prices
All prices (mentioned on the price list or webpage: www.honigs-europe.com)
include GST. The prices are in EURO and understood as EXW out of our location
in Mainz Germany.
Shipping takes place on invoice to recipients risks and costs.
Circumstances, that hamper or disable the production/shipping of our products,
i.e.force majeure, war, strike, rebellion, official measures, lack of energy
or resources, operating break down, failure of suppliers relief us from our
obligation of delivering.
3. Return and Exchange
Return and Exchange is possible within a period of fourteen (14) days with
the original invoice or receipt. The time limit starts with the obtain of the
goods. Online orders will be on time if sended out within the limit.
All goods, that remain at the recipient for more than fourteen (14) days are
considered as bought. There is no possibility of return/exchange for specifically
manufactured goods (i.e. embroided hats) or goods clearly produced for personal
requirements.

Evident damages have to be claimed immediately. Non evident damages fall under
the regulations of the law. All claims within the legal limit have to be addressed
to the above mentioned contact.
Evidently damaged packages are to be opened under attendance of the deliverer.
In case of products being damaged a damage report will be filled out. Please
note, that we can not respect your claims without this report.
In case of return, the recipient has to pay the shipping costs, if the value
of the order is less than 40,00 € (fourty). If the value is more than
40,00 €, Honig´s Europe takes care of the shipping costs.
If the goods are undamaged, unused and originally packed, Honig´s Europe
will pay back the value immediately by bank transfer or in cash.
4. Due Date, Payment and Default
The price becomes due immediately within 14 days. If the recipient comes in
default, it is Honig´s Europes right, to demand interests of 5% above
the ECB rate of interest p.a. If a higher loss/damage to Honig´s Europe
is proved, Honig´s Europe has the right to claim for it.
5. Inclusion, Retention
The recipient has a right for inclusion only, if his claims are considered
effective or accepted by Honig´s Europe. Moreover, the recipient is only
authorised for a retention, if his claim is based on the same contractual relationship.
6. Property reservation
The goods remain the property of Honig´s Europe until full payment or
settlement of all obligations.
7. Defectiveness Liability
If the product is deficient, the recipient can request repair or replacement
delivery. If Honig´s Europe is not able to proceed with repair/replacement
delivery due to disproportion, or if it is delayed over the appropriate time
limits out of reasons, that Honig´s Europe is responsible for, or if
it fails due to other reasons, it is the orderers choice, to either request
a discount or step back from the contract and claim for compensation.
If not mentioned further below, other claims are impossible – no matter
out of what legal arguments. Honig´s Europe is not liable for damages,
that did not arise on the delivered good, especially Honig´s Europe is
not liable for missed profits or other capital losses of the orderer.
The above mentioned regulation is not valid, if the cause of the damage is
based on intention or negligence or there is a personal injury. Moreover it
is invalid, if the orderer claims as per §§ 1, 4 Produkthaftungsgesetz.
If Honig´s Europe neglects a contract essential duty, the liability to
pay property damages is limited to the usually arising damage.
Limitation is regulated by the legal limits.
8. Data Protection
Your address will be saved in our data base in order to guarantee a quick and
correct handling. The treatment of your data happens under conformity of the
regulations of the Bundesdatenschutzgesetz
9. Inefficacy of a Direction
In case of a inefficacy of a direction in these terms of business, Honig´s
Europe has the right, to replace the ineffective direction with an effective
direction, which will have as much corresponding economical success as the
ineffective.
10. Shipping Conditions
1. Shipping: All orders will be packed and shipped ex Mainz immediately after
the payment is confirmed. Payment is possible by credit card (Visa or MasterCard)
or bank transfer.
2. Times and Costs:
a) Shipping Time within Germany is 1-2 Days, Express Service available on request.
Prices: All Shipments: € 8,00 (will be automatically added to invoice/charged
to credit card).
b) Shipping Time within Europe is 1-3 Days, Express Service available on request.
Prices: All Shipments: € 15,00 (will be automatically added to invoice/charged
to credit card).
c) Shipments conditions: DDP
d) For orders with a value of € 250,00 and more (excluding shipping costs)
we will create an individual and interesting shipping offer!
e) Honig´s Europe has the right to refuse (temporary or absolute) shipping
out goods on invoice, i.e in case of default, ongoing default summons. In such
cases shipping is only possible by paying in advance.
3. In case you should not like an item, please send it back to us within 14
days (sending out in time is sufficient). Please mark your account number (for
the repayment) and the item you are sending back. Shipping costs will have
to be covered by you, if the value is less than 40,00€. Shipments with
unpaid costs will not be accepted by us.
4. Honig´s Europe will only accept unused, originally packed goods for
return. Please remove tags and foils only, once you are sure you will keep
the items.
5. In case we will identify signs of usage, or if the original packing has
been removed, Honig´s Europe will not accept these items for return/exchange.
Those items will be send back to you on your costs.
6. Please note, that the 14 day time limit is not valid for copyable items
like books.

11. Legal Domicile
If the orderer is located in a foreign country (including EU), or can his place
of residence not be determined, the legal domicile is Mainz, Germany.
